In a Dec. 3 ruling, the Sixth Circuit Court denied the government?s motion to transfer the case to the Fifth Circuit and the D.C. Circuit, while also rejecting as ?moot? the Biden administration?s attempt to overturn a hold on the mandate. OSHA on Nov. 5 published an Emergency Temporary Standard (ETS) that would require private employers with 100 or more employees to impose a mandatory COVID-19 vaccinate-or-test policy. Under the rule, unvaccinated workers would also have to wear masks inside the workplace, with violators facing potential penalties of thousands or even tens of thousands of dollars per incident. COVID-19 is the disease caused by the CCP (Chinese Communist Party) virus, also known as SARS-CoV-2 or the novel coronavirus. After the OSHA rule was published, it triggered a torrent of lawsuits from Republican-led states, individuals, and businesses. On Nov. 12, the Fifth Circuit granted a motion to stay the ETS and ordered that OSHA ?take no steps to implement or enforce? it ?until further court order, prompting OSHA to announce it has suspended implementation pending litigation. Several legal challenges to the OSHA rule were later rolled into one and the Ohio-based Sixth Circuit Court?of which 11 of 16 judges are Republican appointees?was selected via lottery to hear the consolidated lawsuits. The Biden administration then filed a motion on Nov. 23 to lift the Fifth Circuit?s stay on the mandate and get the case moved to a potentially more favorable court. The Sixth Circuit Court?s Dec. 3 ruling denied both requests. Rob Natelson, a former constitutional law professor, wrote in a recent op-ed for The Epoch Times that it?s likely the legal challenge to the OSHA rule will end up before the Supreme Court. Natelson said the high court will likely weigh several issues relating to the ETS, including whether the mandate exceeds the powers the Constitution grants to the federal government, whether OSHA exceeded its authority under its statute, and if the vaccine-or-test requirement denies individuals due process of law. The Fifth Circuit ruling described the OSHA rule as ?fatally flawed? and said that the mandate would likely be declared unconstitutional. In its Nov. 23 filing, the Biden administration argued that the Fifth Circuit panel erroneously interpreted the OSHA mandate, saying that ?the speculative compliance costs and similar harms asserted by regulated parties cannot overcome the extraordinary harms to the public interest detailed above.? ?Simply put, delaying the standard would likely cost many lives per day, in addition to large numbers of hospitalizations, other serious health effects, and tremendous expenses,? Here?s Why By Christian Yates, University of Bath July 15, 2021 COVID Vaccine Success More vaccinated people are dying of COVID than unvaccinated people, according to a recent report from Public Health England (PHE). The report shows that 163 of the 257 people (63.4%) who died within 28 days of a positive COVID test between February 1 and June 21, had received at least one dose of the vaccine. At first glance, this may seem alarming, but it is exactly as would be expected. Here?s a simple thought experiment: imagine everyone is now fully vaccinated with COVID vaccines ? which are excellent but can?t save all lives. Some people who get infected with COVID will still die. All of these people will be fully vaccinated ? 100%. That doesn?t mean vaccines aren?t effective at reducing death. The risk of dying from COVID doubles roughly every seven years older a patient is. The 35-year difference between a 35-year-old and a 70-year-old means the risk of death between the two patients has doubled five times ? equivalently it has increased by a factor of 32. An unvaccinated 70-year-old might be 32 times more likely to die of COVID than an unvaccinated 35-year-old. This dramatic variation of the risk profile with age means that even excellent vaccines don?t reduce the risk of death for older people to below the risk for some younger demographics. PHE data suggests that being double vaccinated reduces the risk of being hospitalized with the now-dominant delta variant by around 96%. Even conservatively assuming the vaccines are no more effective at preventing death than hospitalization (actually they are likely to be more effective at preventing death) this means the risk of death for double vaccinated people has been cut to less than one-twentieth of the value for unvaccinated people with the same underlying risk profile. COVID Teen Selfie COVID infections are currently highest in young people. However, the 20-fold decrease in risk afforded by the vaccine isn?t enough to offset the 32-fold increase in underlying risk of death of an 70-year-old over a 35-year-old. Given the same risk of infection, we would still expect to see more double-vaccinated 70-year-olds die from COVID than unvaccinated 35-year-olds. There are caveats to that simple calculation. The risk of infection is not the same for all age groups. Currently, infections are highest in the youngest and lower in older age groups. Think of it as ball-bearing rain One way to imagine the risk is as a rain of differently sized ball bearings falling from the sky, where the ball bearings are the people that get infected with COVID. For simplicity?s sake, let?s assume there are roughly equal numbers of ball bearings in each age group. In each age category, there is also a variation in the size of the balls. The balls representing the older groups are smaller, representing a higher risk of death. Now imagine there?s a sieve that catches many of the balls. Most people who get COVID will not die (most balls get caught in the sieve). But some of the smaller balls fall through. The older you are, the more likely you are to fall through the holes. The balls that make it through the first sieve are hugely skewed towards older age ranges, represented by the smaller ball bearings. Before COVID vaccines came along, the people that fell through the holes represented the people who would die of COVID. The risk was massively skewed towards older people. Vaccination provides a second sieve underneath the first, to prevent people from dying. This time, because we haven?t vaccinated everyone, it?s the holes in the sieve that are of different sizes. For older people who?ve had both doses, the holes are smaller, so many ball-bearings are stopped. The vaccines will save many of those who would previously have died. For younger people the holes in the vaccine sieve are currently bigger as they are less likely to have received both doses and so more likely to fall through the sieve. If all the filtering were just done by the second sieve (with no skew in risk of death by age, represented by the first sieve), then we might expect younger unvaccinated people to account for a larger proportion of the deaths. But it isn?t. The first sieve is so hugely biased towards older people that even with vaccination, more of them slip through the second sieve than the younger unvaccinated people. Given the UK?s vaccination strategy (vaccinate older, more vulnerable people first), you would expect high proportions of the people who die from COVID to have been vaccinated. And that is exactly what we see in the data. The fact that more vaccinated people are dying than unvaccinated people does nothing to undermine vaccine safety or effectiveness. In fact, it?s exactly what we?d expect from the excellent vaccines, which have already saved tens of thousands of lives. The combination that enables this tragic and avoidable loss of hundreds of thousands of lives includes (1) The CARES Act, which provides hospitals with bonus incentive payments for all things related to COVID-19 (testing, diagnosing, admitting to hospital, use of remdesivir and ventilators, reporting COVID-19 deaths, and vaccinations) and (2) waivers of customary and long-standing patient rights by the Centers for Medicare and Medicaid Services (CMS). In 2020, the Texas Hospital Association submitted requests for waivers to CMS. According to Texas attorney Jerri Ward, ?CMS has granted ?waivers? of federal law regarding patient rights. Specifically, CMS purports to allow hospitals to violate the rights of patients or their surrogates with regard to medical record access, to have patient visitation, and to be free from seclusion.? She notes that ?rights do not come from the hospital or CMS and cannot be waived, as that is the antithesis of a ?right.? The purported waivers are meant to isolate and gain total control over the patient and to deny patient and patient?s decision-maker the ability to exercise informed consent.? Creating a ?National Pandemic Emergency? provided justification for such sweeping actions that override individual physician medical decision-making and patients? rights. The CARES Act provides incentives for hospitals to use treatments dictated solely by the federal government under the auspices of the NIH. These ?bounties? must paid back if not ?earned? by making the COVID-19 diagnosis and following the COVID-19 protocol. The hospital payments include: * A ?free? required PCR test in the Emergency Room or upon admission for every patient, with government-paid fee to hospital. * Added bonus payment for each positive COVID-19 diagnosis. * Another bonus for a COVID-19 admission to the hospital. * A 20 percent ?boost? bonus payment from Medicare on the entire hospital bill for use of remdesivir instead of medicines such as Ivermectin. * Another and larger bonus payment to the hospital if a COVID-19 patient is mechanically ventilated. * More money to the hospital if cause of death is listed as COVID-19, even if patient did not die directly of COVID-19. * A COVID-19 diagnosis also provides extra payments to coroners. CMS implemented ?value-based? payment programs that track data such as how many workers at a healthcare facility receive a COVID-19 vaccine. Now we see why many hospitals implemented COVID-19 vaccine mandates. They are paid more. Outside hospitals, physician MIPS quality metrics link doctors? income to performance-based pay for treating patients with COVID-19 EUA drugs. Failure to report information to CMS can cost the physician 4% of reimbursement. Because of obfuscation with medical coding and legal jargon, we cannot be certain of the actual amount each hospital receives per COVID-19 patient. But Attorney Thomas Renz and CMS whistleblowers have calculated a total payment of at least $100,000 per patient. What does this mean for your health and safety as a patient in the hospital? There are deaths from the government-directed COVID treatments. For remdesivir, studies show that 71?75 percent of patients suffer an adverse effect, and the drug often had to be stopped after five to ten days because of these effects, such as kidney and liver damage, and death. Remdesivir trials during the 2018 West African Ebola outbreak had to be discontinued because death rate exceeded 50%. Yet, in 2020, Anthony Fauci directed that remdesivir was to be the drug hospitals use to treat COVID-19, even when the COVID clinical trials of remdesivir showed similar adverse effects. In ventilated patients, the death toll is staggering. A National Library of Medicine January 2021 report of 69 studies involving more than 57,000 patients concluded that fatality rates were 45 percent in COVID-19 patients receiving invasive mechanical ventilation, increasing to 84 percent in older patients. Renz announced at a Truth for Health Foundation Press Conference that CMS data showed that in Texas hospitals, 84.9% percent of all patients died after more than 96 hours on a ventilator. Then there are deaths from restrictions on effective treatments for hospitalized patients. Renz and a team of data analysts have estimated that more than 800,000 deaths in America?s hospitals, in COVID-19 and other patients, have been caused by approaches restricting fluids, nutrition, antibiotics, effective antivirals, anti-inflammatories, and therapeutic doses of anti-coagulants. We now see government-dictated medical care at its worst in our history since the federal government mandated these ineffective and dangerous treatments for COVID-19, and then created financial incentives for hospitals and doctors to use only those ?approved? Peng is far from the only person who has suffered at the hands of the CCP. The U.S. State Department estimated as of October that up to 2 million Uyghurs and other minorities in China had been forced into internment camps since 2017, according to CNN. Given the Chinese government?s genocide of Uyghurs and suppression of any information potentially harmful to the communist regime, the WTA clearly made the right decision in pulling its events from the country. Sadly, at least one major sports league in the United States has yet to break ties with China or condemn its repressive government. Boston Celtics center Enes Kanter Freedom has been outspoken in his criticism of Chinese oppression and the NBA?s relationship with that country. While he said NBA Commissioner Adam Silver had not banned him from speaking out, Silver and the league hadn?t supported him, either. ?If they were really supporting me, they would have put something out there,? Freedom told CNN in October. ?They would have put out some kind of statement.? The NBA is in the midst of an eight-year apparel deal with Nike that began in the 2017-18 season, ESPN reported. The sportswear giant has been connected to forced labor in China. In a statement earlier this year, Nike said it was ?concerned about reports of forced labor in, and connected to, the Xinjiang Uyghur Autonomous Region (XUAR),? CNN reported. However, the company insisted that it ?does not source products from the XUAR and we have confirmed with our contract suppliers that they are not using textiles or spun yarn from the region.? According to Forbes, this does not mean Nike isn?t profiting from slave labor. A study by the Australian Strategic Policy Institute found Nike was one of 83 companies potentially connected to slave labor in China. ?According to the researchers, Uighurs, a persecuted ethnic minority from China?s western Xinjiang region, have been funneled to work in factories in other provinces under conditions ?that strongly suggest forced labour,'? Forbes reported. So even if Nike is not sourcing products directly from the XUAR, there is strong evidence to suggest Uyghurs are being forced to work for the company in factories all over China. The NBA should absolutely cut ties with China and any company linked to slave labor in that country.
